Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and KCORBOT LLC, a Delaware limited liability company (“ClipCapsule,” “we,” “us”). By creating an account, downloading the app, or otherwise using ClipCapsule, you agree to these Terms, our Privacy Policy, our Acceptable Use Policy, and our DMCA Policy. If you don't agree, don't use ClipCapsule.

If you are using ClipCapsule on behalf of an organization, you represent that you have authority to bind that organization.

ClipCapsule is a personal video time-capsule. You bring in old home videos from Photos, Files, or the camera, and the app processes them on your device into clips you can browse, organize, and optionally sync to the cloud and share with family members you invite.

You must be at least 13 years old to use ClipCapsule.

If you are between 13 and the age of majority in your jurisdiction, you must have permission from a parent or legal guardian who accepts these Terms on your behalf.

You are responsible for the security of your account: protecting your Apple ID, your email, your password, and any device that stays signed in. Tell us promptly at support@clipcapsule.app if you suspect unauthorized access.

You retain all rights in the videos and other content you bring into ClipCapsule (“Your Content”). We claim no ownership of Your Content.

To run ClipCapsule for you, you grant us a worldwide, non-exclusive, royalty-free license to store, transmit, encode, transcode, back up, and display Your Content solely for the purpose of providing the service to you and the family members you have explicitly invited. This license is limited to what we need to deliver the product. It ends when you delete the content or your account (subject to the backup-retention window described in our Privacy Policy).

We will not use Your Content to train machine- learning models for any other user or product, sell it, license it to advertisers, or display it to anyone outside your account and your invited family members.

You represent and warrant that:

• You own Your Content or have all rights necessary to share it.
• Your Content does not violate any law or any third party's rights.
• People depicted in Your Content have given any consents required by your local law before you share their image with family members.

You agree to use ClipCapsule only as permitted by these Terms and our Acceptable Use Policy. Violations may result in suspension or termination of your account.

Family sharing lets you invite people to a shared library. The inviter is the “admin” of the family group and can:

• Invite or remove members
• Remove content shared into the family library
• Transfer admin status to another member

When you join someone else's family library, the admin can see any content you contribute to the family library and can remove you at any time. Content you keep private to your own account is never visible to family members.

ClipCapsule has a free tier and paid subscriptions sold through Apple In-App Purchase:

• Personal — $4.99 / month or $39.99 / year
• Family — $9.99 / month or $79.99 / year, up to 6 members

Prices may vary by region. The price you see in the App Store at the time of purchase is the price that applies to you.

Auto-renewal

Subscriptions auto-renew at the end of each period unless you turn off auto-renewal at least 24 hours before the period ends. Manage and cancel from Settings → [your name] → Subscriptions on your iPhone or iPad. We cannot cancel App Store subscriptions on your behalf.

Refunds

All payments are processed by Apple. Refund requests for App Store purchases are handled by Apple under Apple's refund policy. Where required by local law (for example, the EU 14-day right of withdrawal), the statutory right applies.

Changes to pricing

We may change prices for future billing periods. We will notify you before any price change affects your subscription. Active periods will be honored at the price you originally agreed to.

Each tier has a storage limit (Free: 5 GB, Personal: 100 GB, Family: 1 TB pooled). If you exceed your limit, new uploads are paused until you free space or upgrade. Existing content is never deleted for exceeding your limit.

If you downgrade or cancel, your content remains accessible read-only for at least 30 days. After that, if you are over the new tier's limit, we will email you with a deletion notice giving you at least 14 additional days to download or upgrade before any content is removed.

You can delete your account at any time from the iOS Account screen. Deletion follows the timeline described in our Privacy Policy.

We may suspend or terminate your account if you materially violate these Terms or the Acceptable Use Policy, if a court or law requires us to, or if continuing to provide the service to you poses a risk to other users or to us. Where it is reasonable to do so, we will give you notice and a chance to fix the issue.

CLIPCAPSULE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA YOU UPLOAD WILL NEVER BE LOST OR CORRUPTED. WE STRONGLY RECOMMEND KEEPING YOUR OWN BACKUPS OF IRREPLACEABLE CONTENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL KCORBOT LLC OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. If those laws apply to you, some or all of the disclaimers and limitations above may not apply, and you may have additional rights.

You agree to defend, indemnify, and hold harmless KCORBOT LLC and its officers, employees, and contractors from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising from (a) Your Content, (b) your use of the service in violation of these Terms or applicable law, or (c) your violation of any third party's rights.

These Terms are governed by the laws of the State of Delaware, excluding its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

We want to resolve disputes quickly and informally. Before filing any formal claim, please email legal@clipcapsule.app with a description of the issue and what you'd like us to do. We will do the same if we have a complaint about you. If we can't resolve it within 60 days, either party may proceed.

Arbitration and class waiver

Except for (i) claims that may be brought in small-claims court and (ii) injunctive or equitable relief to protect intellectual property rights, any dispute arising out of or relating to these Terms or the service will be finally resolved by individual binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in the English language, in Delaware, U.S.A. You and KCORBOT LLC each waive any right to a jury trial and to participate in a class or representative proceeding.

We may update these Terms from time to time. We will give you at least 30 days' notice for material changes, in the app or by email. Your continued use of ClipCapsule after the change takes effect means you accept the updated Terms. If you don't agree, stop using the service before the change takes effect.

These Terms (together with the Privacy Policy, Acceptable Use Policy, and DMCA Policy) are the entire agreement between you and us about the service. If any provision is held unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them as part of a merger, acquisition, or sale of assets. There are no third-party beneficiaries.
